Information from third-party sources. In the course of business development and marketing, we may obtain business contact information (such as name, business email, business phone, title, and company) from third-party data providers, professional networking platforms, publicly available sources, and referrals. We do not intentionally collect sensitive personal information (such as Social Security numbers, financial account numbers, government IDs, health, or biometric data) through the Site. Please do not submit such information through the Site; sensitive or confidential information should be exchanged only under a signed engagement or confidentiality agreement.

  • With your direction or consent. We may share information when you direct us to or otherwise consent.

Some sharing of information for analytics or advertising purposes may be considered a "sale" or "sharing"/"targeted advertising" under certain state laws. See Section 8 for how to opt out.

5. Email and Marketing Communications

If we send you marketing emails, each message will include an unsubscribe link, and you may opt out at any time by following that link or by emailing kit@elevatusadvisory.com. We may still send you non-marketing communications, such as responses to your inquiries or messages relating to an active engagement. We honor opt-out requests and handle commercial email consistent with the CAN-SPAM Act, and, for recipients in Canada, Canada's Anti-Spam Legislation (CASL), as well as other applicable anti-spam laws.

6. Cookies and Tracking Technologies

The Site uses cookies and similar technologies to operate the Site, remember your preferences, understand how the Site is used, and measure the performance of our content. The Site is built and hosted on a third-party website platform that may set cookies necessary for the Site to function, and we may use analytics tools that set cookies to collect aggregated usage data.

You can usually control cookies through your browser settings, including blocking or deleting cookies. Disabling some cookies may affect how the Site functions. Because there is no common industry standard for responding to "Do Not Track" signals, the Site does not currently respond to them.

7. Automated and AI-Assisted Processing

We may use automated tools and artificial intelligence (AI)-assisted tools to operate and improve the Site, to analyze and respond to inquiries, to create and measure our communications and marketing, and to analyze Site usage. Some content on the Site may also be generated or assisted by AI tools.

We do not use solely automated processing — including profiling — to make decisions that produce legal or similarly significant effects concerning you. Where our service providers process information using AI-assisted tools on our behalf, they are permitted to use it only to provide services to us. If you have questions about the automated processing of your information, contact us using the details in Section 15.

8. Your Privacy Rights

Texas residents (Texas Data Privacy and Security Act)

If you are a Texas resident, you may have the right to:

  • confirm whether we process your personal data and access that data;

  • correct inaccuracies in your personal data;

  • delete personal data you provided or that we obtained about you;

  • obtain a portable copy of personal data you previously provided; and

  • opt out of the processing of your personal data for purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) certain profiling.

Residents of other states

Residents of certain other states (such as California, Virginia, Colorado, Connecticut, and others with comprehensive privacy laws) may have similar rights, including the right to know, access, correct, delete, and obtain a copy of personal information, and to opt out of the sale or sharing of personal information and of targeted advertising. California residents also have the right not to receive discriminatory treatment for exercising their rights.

How to exercise your rights

To submit a request, email us at kit@elevatusadvisory.com with the nature of your request. We will take reasonable steps to verify your identity before responding, and we will respond within the timeframe required by applicable law. You may use an authorized agent to submit a request where the law permits.

Appeals

If we decline to take action on your request, you may appeal our decision by replying to our response or emailing kit@elevatusadvisory.com with the subject line "Privacy Appeal." We will respond to your appeal within the time required by applicable law. If your appeal is denied, you may contact the Texas Attorney General or the applicable regulator in your state.

9. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy — including to provide and improve our services, communicate with you, maintain business records, and comply with our legal obligations — and then for a reasonable period thereafter, after which we delete or de-identify it. Retention periods vary based on the type of information and the purpose for which it is held.

10. Data Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, or alteration. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any credentials you use confidential.

The Site may link to or integrate third-party websites, tools, and services (such as a scheduling tool or external content). We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing information to them.

The Site is intended for business professionals and is not directed to children under 18, and we do not knowingly collect personal information from children under 13. 13. Users Outside the United States, Including Canada

The Site is operated in, and the information we collect is processed and stored in, the United States. The Site may be accessed from the United States, Canada, and other countries.
